Present: Commissioners Steven LaBranche, Fred Rollinson, Linda Haspel, and Sandra Larsen.

Staff Present: Amy Usowski Conservation Agent, Shana Brogan Administrative Assistant.

Not Present: Vivien Cook, Stephen Smith.

Also Present: Gerald Trantina, Linda Rossetti, Wendy and Galileo Bonfini, Eileen Reynolds, Forest Belval of Beach Plum Association, Laura Schofield of Schofield Bros of Cape Cod, Pete Markunas of Woods Hole Group.

6:05PM Steven LaBranche opened the meeting.

Notice of Intent filed by Galileo and Wendy Bonfini.~Applicant proposes construction of single family dwelling and sewage disposal system at property located at 45 Garden Lane, Map 10, Parcel 398.
Matt Farrell represented the applicant and said the property is currently vacant land with a bordering vegetated wetland, and there will be 3,000 sq ft of disturbance within the buffer zone, overall encompassing 689 sq. ft. of deck, 820 sq. ft. of excavation for the house, and 1,438 sq. ft. of disturbance to the land. Matt Farrell continued saying he would install a silt fence limit of work, and they would raise the grade around the house by 4’. Linda Haspel asked about the five high bush blueberry and ten low bush blueberry to be replanted and how that figure was determined. Matt Farrell said it was based on the area left cleared for building. Amy Usowski noted in past projects that a ‘No Mow Zone’ had been established as mitigation for clearing and asked for an alternatives analysis as to why this is the best place to put the house, Matt Farrell said he had not discussed materials for the deck and would bring an alternatives analysis to the next meeting. He also said that the applicants are trying to close on the property in early September but need a building permit to do so. Matt Farrell asked for a continuance to provide the commission with more accurate mitigation plantings, an alternatives analysis, and construction protocol.

6:30PM
Announcements
Amy Usowski informed the Commission:
Pond coalition meeting on August 17, 2011 at 2:30PM at the town hall with the engineer the town hired to do a pond study so that various boards could comment on the presentation before it is brought to the selectmen the next day, August 18, at 4:00PM.

Wednesday, September 7, 2011 at 7PM town council will be available for the Commission to ask questions on procedures and practices.

A meeting time of Wednesday, August 3 at 12:30PM was set for Commission members to meet at the Spaunburg property to view the upcoming vista pruning permit request.

Linda Haspel said she would represent the Commission for the Eastham Community Preservation Committee.

Administrative Reviews

6:30PM
Administrative Review permit requested by Eileen and Meade Reynolds, 5 Bridge Pond Drive, Map 13, Parcel 33. Applicant requests 10’ encroachment into 200’ buffer of a riverfront area for construction of a deck.
Amy Usowski recommended keeping the work limit 5’ from the edge of the proposed deck, and she would like to check the limit before work starts. Eileen Reynolds noted that the deck may not be as large as proposed, as it may be too costly, however they wanted approval for the builder and said he driveway would be made of gravel.

Administrative Review permit requested by Beach Plum Association 105-125 Shurtleff Road.  Applicant requests to decrease the size of their top landing platform of beach access stairway. Forest Belval said the applicants would like to decrease the top landing and reuse the materials. Sandra Larsen noted there would be a height difference and asked how it would be stabilized. The Commission agreed that some native bank sand could be brought in to level it out. After discussion, the Commission agreed with Steven LaBranche’s suggestion to use beach grass in the area of existing landing to be removed as it would not need as much water and no excavating or digging would occur for planting larger shrubs.

6:45PM
Administrative Review Permit requested by Richard MacNeill, 420 Bridge Road Map 20, Parcel 71.  Applicant is upgrading septic system within 100’ buffer to a salt marsh.
Amy Usowski noted that there was substantial lawn area, and the new owners may possibly revert to not mowing as much to provide more habitat value and she was not sure why the septic could not be moved over to save the cedar tree. It was determind if the specified cedar tree is compromised due to construction, then four cedars are to be replanted in its place.

Request for Determination of Applicability filed by Victor Arruda and Ann Marie Beaudoin. Applicant proposes reconstruction of existing driveway with pervious pavers at property located at 51 Longstreet Lane, Map 10, Parcel 344.
Amy Usowski said the drive is currently, asphalt and shell which they want to make pervious pavers. Pete Markunas represented the applicant, and said that the driveway is sloping away from the bank. Amy Usowski said that she wanted to make sure that run off goes down into the ground and not off. Sandra Larsen asked if the sand that would be used is unilock the representative said they would be using unilock which Sandra Larsen expressed concern for hazardous components of the material during installation. Pete Markunas expressed concern for the product as well and said they could not use plain sand as it would not stay in place. Steven LaBranche suggested using stone and matting for stabilization. Pete Markunas said he would try to contact the applicant to see if they were amenable to using pea stone or stone dust. To be continued later in the evening to allow Pete Markunas to call the homeowner for more information.

7:10PM
Notice of Intent filed by Hans Noetzli, Sherwood Road Nominee Trust. Applicant proposes reconstruction of existing rock revetment and extension of return at property located at 20 Sherwood Road and 1620 Samoset Road , Map 13, Parcel 133A, and Map 16, Parcel 25.
Pete Markunas represented the applicant and explained through a series of photographs the erosion that has taken place over the past year and said the top of the bank is now 10’ from the edge of the applicant’s deck. He continued saying they would also utilize sand drift fencing to prevent further erosion as well as transition the revetment to a rough face to deflect wave action. As mitigation, the applicant would place 425 cubic yards at the return annually on town property. Pete Markunas also noted that they filed with MESA recently and do not expect to hear back for about a month. Amy Usowski noted that the extension would encroach approximately 25’ onto town property, thus the applicant will meet with the selectmen who will determine property logistics. Amy Usowski also said the Commission needs to consider whether the project will have an adverse impact on the abutter. Sandra Larsen asked that language and conditions used in recent revetment filings be used in the Orders of Conditions for this project so as to be consistent with benchmark monitoring. Pete Markunas agreed the absent committee members could vote on the project after viewing the meeting on DVD at a later time as well as the information provided, and asked for a continuance until August 23, 2011.

7:35PM
Continuation of RDA hearing filed by Victor Arruda and Ann Marie Beaudoin heard at 6:55PM.
Pete Markunas informed the commission that he could not contact the applicant and suggested using stone dust. Amy Usowski expressed concern since the commission has not allowed stone dust in the past.  Sandra Larsen said if the pavers are pervious the Commission has to be confident it is something we can assess afterwards. The Commission agreed that eco-priora pavers and stone dust be used and the original proposed sand is not allowed. Amy Usowski stated if the applicant does not want to use the specified materials they have to come back to the Commission for another RDA hearing.
